Any business (Unternehmer) under § 2 UStG that is on standard VAT taxation is generally entitled. This includes:

Requirements for Input VAT Deduction
All of the following conditions must be met:
- You are a registered VAT business (Unternehmer § 2 UStG), not a Kleinunternehmer.
- The supply or service was used for your business (at least 10 % business use, § 15 Abs. 1 sentence 2 UStG).
- You hold a proper invoice containing all mandatory details per § 14 UStG.
- The supplier has a valid tax number or VAT ID.
- The supply is not VAT-exempt under § 4 UStG.

When Can You Deduct the Input VAT?
Timing is one of the most common traps. You may deduct input VAT in exactly the VAT period in which both conditions coincide: the service has been delivered and you hold the proper invoice. The right to deduct arises only once both are met.
Important: The payment date is irrelevant. Unlike the cash-accounting method for your output VAT, input VAT depends on when the supply and invoice exist, not when you transfer the money. If a December invoice reaches you in January, you deduct the input VAT in January.

Worked Example: How a Payable or Refund Arises
At the end of the VAT period, you set your output VAT (from invoices to customers) against your input VAT (from your purchases). The difference is either your amount payable or your refund.
A second scenario shows the input-VAT surplus: if you buy equipment for €11,900 (including €1,900 VAT) in your founding month and have only €500 of output VAT, a surplus of €1,400 arises, which the Finanzamt pays out. What Is NOT Deductible?
§ 15 Abs. 1a and 1b UStG exclude certain expenses fully or partially even when the invoice is correct. The key is to separate VAT from income tax, the two follow different rules:

Input VAT from purchase or leasing is deductible if the car is predominantly used for business.
