PIT-5 in Poland: what is it, and do you still file it?

PIT-5 is no longer a monthly filing in Poland. Learn what AI bookkeeping prepares, when a sole trader pays a PIT advance and how the annual return differs.

PIT-5 is neither a separate tax nor a monthly declaration that a Polish sole trader must file today. It is the former name of a form used for a PIT advance. In 2026, you still calculate and pay advances when due, but you do not submit PIT-5 for that purpose. AI bookkeeping can prepare a calculation for review. Payment and the annual return remain separate actions.

If you run a sole proprietorship in Poland, known as a JDG, and someone asks you to “prepare PIT-5”, clarify the intended result. They might mean a calculation report, an amount to transfer or a document covering the whole year. These serve different purposes. Here is how to interpret the names and check what remains to be done before treating a month as complete.

What do PIT-5 and PIT-5L mean?

PIT is Poland’s personal income tax. The old PIT-5 form reported a monthly advance, including advances for business income taxed under the progressive tax scale. PIT-5L related to the flat tax regime. The letter “L” does not mean an additional tax or another payment on top of PIT.

The monthly filing obligation was abolished from 1 January 2007 through the Act of 16 November 2006, Article 1 point 49 and Article 22. Today’s advance payment obligations are set out in Article 44 of the PIT Act. An old form found online therefore does not provide current instructions for settling your tax.

The terminology survives in everyday business language and some accounting applications. “PIT-5 for October” may simply mean a working calculation for that period. Read the document’s description: does it explain a calculation, or is it an annual return intended for submission? The number printed on it does not prove that anything has been sent to the tax office.

What do you do instead of filing PIT-5?

For ordinary monthly advances under the tax scale or flat tax, a JDG keeps the appropriate records, calculates the advance and makes a payment when required. You do not replace PIT-5 with a monthly PIT-36. PIT-36 and PIT-36L are annual returns.

Ryczałt, Poland’s revenue-based tax regime, follows different calculation rules. Do not transfer the expense-deduction logic of PIT-5 into a ryczałt calculation. A limited liability company, or sp. z o.o., also does not settle its own corporate income tax through its owner’s PIT-5. This article mainly concerns a JDG using the tax scale or flat tax.

What does AI prepare when you ask for PIT-5?

A useful response should lead to a calculation for a specific business, year and period. A general explanation of tax rules in a chat is not yet a business tax calculation. The process needs accounting records, the correct tax regime and information from earlier periods.

In Norman, the corresponding report is PIT advance on the Taxes page. As the PIT advance instructions explain, it uses your business records and tax data. It is not a monthly declaration to submit. If an open calculation changes after you add missing information, review the revised amount before paying.

AI can help organise data and explain the result. Keep three questions separate: “How was this amount calculated?”, “Have I reviewed the data?” and “Have I made the transfer?”. Answering the first does not settle the other two. Our guide to how AI prepares taxes for a Polish sole trader explains the wider process.

A useful request might be: “I run a JDG under the tax scale. Help me review my October 2026 advance: identify the period, year-to-date figures and items that need clarification.” This makes the task specific. It does not imply that every AI chat can access your accounting records or instruct a payment.

How should you review the calculation?

Start with the tax year and period. An October advance relates to October even though its standard payment deadline falls in November. Confusing the transfer month with the accounting period makes later reconciliation harder.

Next, check the tax regime and year-to-date information. Under the ordinary advance calculation method, the amount does not come solely from your bank balance or one month’s profit. Revenue, allowable expenses, deductions and earlier advances matter. If you moved accounting systems during the year, make sure the earlier months are included.

Look for unreviewed transactions. Norman’s public instructions describe a mode in which the revenue and expense ledger, or KPiR, is maintained directly from transactions, including transactions you have not reviewed yet. An amount appearing in the report therefore does not mean you have checked every category and supporting record.

Finally, compare the result with the previous calculation and actual payments. If adding an expense changes the amount, establish why before paying again. When an earlier period needs correction, also check the effect on later advances. Regenerating a report does not cancel a transfer that has already been executed.

When do you pay, and which payment code applies?

The standard deadline for a monthly business income tax advance is the 20th day of the following month. Eligible taxpayers using quarterly advances pay by the 20th day of the month after the quarter. The December or final-quarter advance is due on 20 January of the following year. These rules come from Article 44(6) of the PIT Act.

You pay into your own tax micro-account, or mikrorachunek podatkowy. The official payment-code list distinguishes PIT for tax-scale advances and PPL for flat tax. PPE is the code for current ryczałt payments. Annual return codes such as PIT-36 and PIT-36L relate to different settlements. See Part II of the micro-account regulation’s annex.

Select a tax transfer in your banking app, with the correct payment code and period. If the bank’s label is unclear, verify the mapping with the bank or tax office before sending. Do not select a code simply because it resembles the name of a file your accountant provided.

Example: October’s report has three separate statuses

Suppose a sole trader using the tax scale has reviewed the records and established that PLN 1,800 is payable for October 2026. This is an example of the workflow, not a tax calculation for a particular person.

  1. Prepared: the report shows October, the data used and PLN 1,800. The owner checks the calculation and confirms that the records are complete.
  2. Paid: the owner executes a tax transfer to their micro-account using PIT and the October period. The standard deadline in this example is 20 November 2026. They retain confirmation of the completed payment.
  3. Settled annually: after year-end, the owner includes the relevant information and advances in PIT-36. Neither the October report nor its payment replaces that annual return.

If you prepare the calculation on Monday and transfer the money on Wednesday, the tax remains unpaid between those events. Marking a report as paid should reflect a real transfer. You do not need to look for a UPO receipt for monthly PIT-5, because you are not submitting that declaration.

What remains after the end of the year?

Business income under the tax scale is generally settled through PIT-36; flat-tax business income through PIT-36L. The statutory filing window runs from 15 February to 30 April of the following year. Reconcile annual records, advances due and payments made. Any final balance follows from the annual settlement, not from the title of a monthly report.

In Norman, preparing the annual PIT and downloading its XML file does not automatically submit the return. The annual PIT instructions explain the remaining steps. Keep evidence that the submitted return was accepted, separately from confirmation of any balance payment. If you are choosing a tool for this workflow, see Norman accounting for sole traders in Poland.

Frequently asked questions

What kind of tax is PIT-5?
PIT-5 was a monthly declaration for a personal income tax advance, not a separate tax. Today the name is sometimes used informally for a sole trader’s advance calculation under the Polish tax scale. PIT-5L is the corresponding historical name for flat tax.
Do I have to submit PIT-5 or PIT-5L to the tax office?
No. The monthly filing obligation was abolished from 1 January 2007. You still calculate advances, pay amounts due by the relevant deadlines and settle the year through the appropriate annual return, such as PIT-36 or PIT-36L.
Why does accounting software still prepare PIT-5?
The name may refer to an internal statement of revenue, expenses, deductions and the calculated advance. It helps you review the calculation. Generating that statement does not submit a tax declaration or transfer money to the tax office.
